general terms and conditions of sale for products sold on PRINT ROOM

These conditions govern the sale by ELIAS & JO of T-Shirts, textile products and related accessories.

The prices of our products are indicated in euros, inclusive of all taxes (VAT and other taxes applicable on the day of the order), unless otherwise indicated, and exclusive of processing and shipping costs.
If you order from a country other than mainland France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. ELIAS & JO is not responsible for these duties and taxes. They are your responsibility, both in terms of declarations and payments to the competent authorities and organizations in your country. We advise you to check with your local authorities. All orders, whatever their origin, are payable in euros.
ELIAS & JO reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price list in force at the time of validation of the order and subject to availability.
Products remain the property of ELIAS & JO until full payment has been received.
Please note: as soon as you take physical possession of the products ordered, the risks of loss or damage to the products are transferred to you.

ELIAS & JO reserves the right not to register a payment or confirm an order for any reason whatsoever, particularly in the event of a supply problem or in the event of any difficulty concerning the order received.

Any order placed on the www.printroom.fr website implies acceptance of these General Terms and Conditions. Any confirmation of an order implies your full acceptance of these General Terms and Conditions of Sale, without exception or reservation.
All data supplied and the recorded confirmation shall constitute proof of the transaction.
You declare that you are fully aware of them.
Confirmation of the order will constitute signature and acceptance of the operations carried out.
A summary of your order information and these General Terms and Conditions will be sent to you in PDF format via the e-mail address used to confirm your order.

The fact of validating your order implies for you the obligation to pay the indicated price.
Payment is made by credit card using the secure STRIPE Payements system or via PAYPAL.

The card is debited only when the order is dispatched. In the case of split deliveries, only the products shipped are debited.

In accordance with the provisions of article L.121-21 of the French Consumer Code, you have 14 days from receipt of your products to exercise your right of withdrawal without having to justify your reasons or pay any penalty.
Returns must be made in their original state and complete (packaging, accessories, instructions). In this case, your responsibility is engaged. Any damage suffered by the product on this occasion may be such as to defeat the right of withdrawal.
Except in the case of an error on our part (model or size error), you will be responsible for return shipping costs.
Returns are processed within 10 days of receipt.
If you exercise your right of withdrawal, ELIAS & JO will reimburse the sums paid within 14 days of notification of your request, using the same means of payment as that used for the order.

Our products are offered as long as they are visible on the www.printroom.fr website and while stocks last. For products not in stock, our offers are subject to availability from our suppliers.
If a product is unavailable after you have placed your order, we will inform you by e-mail. Your order will be automatically cancelled and no bank debit will be made.
Furthermore, the www.printroom.fr website is not intended to sell its products in large quantities. Consequently, ELIAS & JO reserves the right to refuse orders of more than 500 identical items.

All items purchased are dispatched within 10 working days of the order being placed, although the majority are dispatched within 3 to 4 days. In busy periods, your delivery may take up to 2 weeks to arrive. If you have still not received your purchase after 3 weeks, please contact us at eliasandjo@gmail.com. Once your order has been confirmed, you will receive an email from us. Products are delivered to the delivery address indicated during the order process, within the time indicated on the order confirmation page.
In the event of a delay in shipment, an e-mail will be sent to you to inform you of any consequences for the delivery time indicated.
In accordance with legal provisions, in the event of late delivery, you have the right to cancel the order under the terms and conditions defined in article L 138-2 of the French Consumer Code. If, in the meantime, you receive the product, we will reimburse you and the delivery costs in accordance with article L 138-3 of the French Consumer Code.
In the case of deliveries by a carrier, ELIAS & JO cannot be held responsible for delays in delivery due exclusively to the customer's unavailability after several proposed appointments.

All our products are covered by the legal guarantee of conformity and the guarantee against hidden defects, as stipulated in articles 1641 et seq. of the French Civil Code. In the event of non-conformity of a product sold, it may be returned, exchanged or reimbursed.
All claims, requests for exchange or refund must be made by (e-mail/telephone/postal mail) within 14 days of delivery.
Products must be returned to us in the condition in which you received them, with all components (accessories, packaging, instructions, etc.). Shipping costs will be reimbursed on the basis of the invoiced rate, and return shipping costs will be reimbursed upon presentation of receipts.
The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.

The products offered comply with current French legislation. ELIAS & JO shall not be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities about the possibility of importing or using the products or services you intend to order.
Furthermore, ELIAS & JO shall not be held liable for any damage resulting from improper use of the product purchased.
Finally, ELIAS & JO shall not be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, external intrusion or the presence of computer viruses.

The language of this contract is French. The present conditions of sale are subject to French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.

All elements of the www.printroom.fr website are and remain the exclusive intellectual property of ELIAS & JO. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual or audio. Any simple link or hypertext link is strictly forbidden without the express written consent of ELIAS & JO.

ELIAS & JO reserves the right to collect nominative information and personal data concerning you. This information is required to process your order and to improve the services and information we send you.
It may also be transmitted to companies that contribute to this relationship, such as those responsible for the management, execution, processing and payment of services and orders.
This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations.
In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify and object to nominative information and personal data concerning you, directly on the website.

ELIAS & JO will archive order forms and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of article 1348 of the French Civil Code.
ELIAS & JO's computerized records will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
